Does anyone have any knowledge about late payment terms? One of our clients is trying to get us to sign up for a late payment clause that is much less advantageous to us than the Late Payment act. In signing up to the clause they say that we waiver our rights to claim late payment under the act. Does anyone know if this is legal?

Many thanks for this. It sounds as if our client is not behaving in the spirit of the act! It sounds as if we could agree in principal to their terms but still claim unfair treatment if it really came to it under the act.
What if...?
They may be unclear of the terms, or even unaware of the provisions of the act that allow a court to overrule such unfair terms.
If they were made aware, then perhaps they would drop the condition.
Which leads one to wonder - what are they really afraid of?
